Distance Sales Agreement

By accepting this agreement, the BUYER acknowledges that upon confirming the order, they will be obligated to pay the order amount and any additional fees such as shipping costs and taxes, if applicable, and that they have been informed accordingly.

2. DEFINITIONS

In the application and interpretation of this Agreement, the following terms shall have the meanings assigned to them below.

MINISTER: Minister of Customs and Trade,
MINISTRY: Ministry of Customs and Trade,
LAW: Law No. 6502 on the Protection of Consumers,
REGULATION: Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188),
SERVICE: Any consumer transaction, other than the supply of goods, performed or promised to be performed for a fee or benefit,
SELLER: A company that offers goods to consumers or acts on behalf of or for the account of a company that offers goods within the scope of its commercial or professional activities,
BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for purposes not related to their commercial or professional activities,
SITE: The website owned by the SELLER,
ORDERING PARTY: A natural or legal person who requests a good or service through the SELLER’s website,
PARTIES: The SELLER and the BUYER,
AGREEMENT: This agreement concluded between the SELLER and the BUYER,
GOODS: Movable property subject to the transaction and intangible goods such as software, audio, video, and similar items prepared for use in electronic environments.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product, whose specifications and sales price are stated below, ordered by the BUYER through the SELLER’s website in an electronic environment. The listed prices and offers on the site are the sales prices. The advertised prices and promises remain valid until updated or changed. Time-limited prices are valid until the end of the specified period.

7. GENERAL PROVISIONS

- The product subject to this Agreement will be delivered to the address specified by the BUYER within a maximum of 30 days. This period starts from the date the contract is established for distance contracts where the goods or services are to be delivered to the BUYER or a third party designated by the BUYER.

- The product is being produced specifically for the consumer upon their request or customized according to their personal needs. Therefore, the right of withdrawal does not apply.

- Shipping costs are the responsibility of the BUYER. The shipping cost is determined by the SELLER when the BUYER creates the order and is communicated to the BUYER during the order process. The total of the product price and shipping cost will be paid by the BUYER.

8. DELIVERY OF THE PRODUCT SUBJECT TO THE AGREEMENT

The product will be delivered to the consumer address from the BUYER. The product will be handed over to the courier according to the information on the SELLER’s website.

9. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the Agreement by rejecting the goods within 14 (fourteen) days from the delivery of the goods to themselves or the person/institution at the specified address, without any legal or criminal liability and without providing any reason. To exercise this right, the BUYER must notify the SELLER via fax, e-mail, or phone within this period, and the product must be unused and/or undamaged. If this right is exercised, the goods must be returned to the SELLER or the courier company authorized by the SELLER within 14 (fourteen) days.

10. RESOLUTION OF DISPUTES ARISING FROM OBLIGATIONS

Any disputes arising from this Agreement, its application, interpretation, or breach shall be governed by Turkish Law. For disputes arising from this Agreement, the courts and enforcement offices of Mersin are authorized.

11. EFFECTIVENESS

This Agreement enters into force after the BUYER reads, is informed, and approves it during the electronic order process on the SELLER’s website.

The BUYER declares that they have read and accepted all terms of this Agreement.
